What makes motorcycle cases different
Florida is a no-helmet state for riders 21 and over with adequate insurance, but the decision not to wear a helmet is often used by the defense to argue comparative negligence even when it's irrelevant to causation. Florida's no-fault PIP system also does not generally apply to motorcycles — meaning recovery for injuries comes from the at-fault driver's bodily-injury coverage and your own uninsured/underinsured-motorist policy.
